Description: Learn how the Texas Estate Codes provides for the appointment of attorneys and guardians ad litem. The court must appoint an attorney or guardian ad litem in certain situations and has the discretion and authority to appoint one or both in others. Practitioners serving as ad litem or seeking to be appointed by the court are encouraged to consult the local rules of the particular county in order to confirm the particular court’s requirements for appointment and to ensure awareness of the court’s expectations. During this webinar we will discuss common situations and scenarios where a court either may or shall appoint an attorney or guardian ad litem, depending on the circumstances. We will also discuss the basic differences between the roles, responsibilities, and duties of the attorney ad litem and guardian ad litem, as well as the limitations imposed by law.
